Public & Regulatory Law Public and regulatory bodies perform their functions and exercise their powers in a challenging legal environment. New legislation is constantly being enacted at national, EU or international level which impacts on the everyday workings of public bodies and organisations. The demand for expert legal advice in the field of public regulation has expanded significantly in recent years in the face of ever increasing levels of public and media scrutiny. Public and regulatory bodies face increasingly sophisticated administrative law challenges to their decisions and a greater readiness on the part of individuals and private organisations to challenge their decisions. Our Public and Regulatory Law Unit acts both for public and private bodies in relation to such challenges.
Our expertise includes advice and assistance to Government departments, State bodies, semi-state organisations and regulators relating to compliance with statutory obligations, the exercise of powers and functions controlled by statute, the interpretation of primary and secondary legislation, the transposition of EU legislation, due process, ultra vires issues, judicial review proceedings, freedom of information requests, ethics in office issues, governance requirements and the application of public procurement and State aid rules and regulations. Our Public and Regulatory Law Unit represents and advises numerous organisations and institutes representing and regulating professionals. We advise and assist these clients on all legal matters including commercial agreements, employment contracts and freedom of movement, health and safety matters, competition law issues, equality and discrimination, grievance procedures, intellectual property protection and exploitation, regulatory issues, disciplinary proceedings, administration and membership issues, dispute resolution and the structuring, interpretation and enforcement of their rules and regulations.
