Construction & Procurement Our Construction & Procurement Group (the “Group”) headed by Bruno Herbots, uses a hands-on practical approach, enhanced by unique operational procedures and bespoke IT systems.
We offer an integrated legal service from inception to completion and beyond. While the best decision is not always obvious, it becomes clear with sound advice. Our Group is trained to find the best solution. We advise on procurement strategy and contract structures as well as handling the negotiations and drafting of construction contracts, professional appointments, development/funding agreements and related documentation.
Construction
Successful relationships depend upon effective communications, honesty and mutual respect. This is not only relevant to the client/lawyer relationship; but also to the relationship between the members of the whole construction team. For this reason, we take particular care in agreeing an integrated contract strategy with each client.
An integrated contract strategy ensures that design, construction, operation and maintenance issues are considered as a whole; and as such decrease claims, as the role/risk allocation is clearly set out from the outset.
Where necessary, we assist our clients in resolving and managing disputes efficiently and with minimum disruption to their businesses. With an invaluable understanding of the construction industry, the Group offers practical and pragmatic advice on the options open to our clients, no matter what stage the dispute has reached. Procurement
We regularly act for public bodies. In helping define our client’s public procurement strategy, we identify the most appropriate way of achieving the sought objectives, taking account of the risks and constraints, leading to discussions about the funding mechanism and asset ownership for the project. We seek to achieve the optimum balance of risk, control and funding for a particular project.
The EU and Irish public procurement rules establish a regime to facilitate competitive, transparent and non-discriminatory purchasing and tendering procedures. We do not perceive these compliance obligations as hurdles, but as commercial opportunities, if used properly. The Group has the cutting-edge experience to assist clients in achieving such opportunities.
When advising on both construction and procurement issues, we look at how to meet business needs. We aim to define clear achievable objectives and success criteria at the outset of the project.
